CHERRY BAKER EDUCATION TERMS & CONDITIONS

1. DEFINITIONS

In the Terms and Conditions the following definitions apply:

  1. Customer: the person purchasing a course, workshop or event from the Company.
    1. Company: Cherry Baker Education 
    1. Course: the supply of an online or in person course
    1. Workshop: the supply of an online or in person workshop
    1. Event: the supply of an online or in person event
    1. Fees: the fees payable in advance.

2. ENROLMENT & FEES

2.1 Booking implies a commitment to pay the published fees.

2.2 Deposits, where payable are non-refundable.

2.3 Fees must be paid in accordance with the Terms and Conditions irrespective of whether the Customer participates in the Course, Workshop or Event. No refund is given for non-usage. 

2.4 Acceptance of a person as a Customer is at the absolute discretion of the Company.

2.5 The Company reserves the right to remove from any Course, Workshop or Event, Customers that fail to comply with its standard practices and procedures. The Company reserves the right to refuse enrolments and/or suggest alternative arrangements if it believes that it will not be in the best interests of other participants and/or the individual concerned to be enrolled on one of it’s Courses, Workshops or Events.

2.6 It is the responsibility of the Customer to ensure they are appropriately qualified and insured to deliver the content shared as part of any Course, Workshop or Event.  

2.7 It is the responsibility of the Customer to check with their GP or other health care professional as to their medical readiness to participate in any sessions delivered as part of a Course, Workshop or Event.

2.8 The Course, Workshop or Event is non-transferable.  A Customer must not share the content or give anyone else access to any part of the Course, Workshop or Event.

2.9 The Company reserve the right to change the fees without notice.  This will not affect those who have already booked on the Course, Workshop or Event at an agreed rate.

3. REFUNDS AND CANCELLATIONS

3.1 Courses, Workshops & Events can be cancelled within the first 14-day cooling off period.

3.2 Where notice to cancel is received outside of condition 3.1, no refunds will be made and fees payable in full will remain due.

3.3 No refunds will be made unless the Company are unable to deliver the sessions, loses access to it’s digital platforms and no acceptable alternative is provided.

4. RIGHTS TO CONTENT; INTELLECTUAL PROPERTY

4.1 Course, Workshop and Event materials and content must not be republished or redistributed in any format, whole or in part.   

4.2 A Customer may use, modify and manipulate materials and content for their own personal educational purposes, but must not otherwise exploit the materials and content.

5. PRIVACY

5.1 The information collection and use of any personal information about the Customer is set out in the Company’s Privacy Policy.

5.2 Personal information that the Customer discloses may be used by the Company, its agents and contractors in relation to the Course, Workshop or Event enrolled onto, including marketing activities in relation to the Course, Workshop or Event

5.3 The Company may disclose any personal information as necessary to satisfy any law, regulation or government request.

6. LIABILITY AND DISCLAIMER

6.1 Except as provided in an applicable Non-excludable Law, we are bound only by the express promises made in these Terms and are not bound by implied terms.

6.2 Except as provided in an applicable Non-excludable Law, we and our affiliates are not liable for indirect, incidental, special or consequential damages, loss or revenue or loss of profits which result from any use of or access to, or any inability to use or access, the Course, Workshop of Event.

7. GENERAL

7.1 The Terms and Conditions will be governed by the laws of England and subject to the exclusive jurisdiction of the courts of England and Wales.  

7.2 The Company reserves the right to revise and amend these Terms from time to time. The Customer will be subject to the Terms in force at the time of enrolment, unless any change to these Terms is required by law or government or regulatory authority in which case the same will apply to a Course, Workshop or Event already enrolled on or started.
